Copyright Policy
All content on the Zemirot Database is in the public domain, is used with permission from the copyright owner, or is licensed from the copyright owner. Users who upload content agree to license that content to the Zemirot Database, as discussed below.
If the supervisors of the Zemirot Database determine that a user did not have permission to upload content, that content will be promptly removed. The supervisors will delete any song lyrics that they determine are not in the public domain unless the Zemirot Database has a license from the copyright owners to display the lyrics or the uploader credibly indicates that he or she wrote the lyrics. They will also delete recordings featuring tunes that they determine are subject to copyright, unless the user or Zemirot Database has permission to post the tunes in question. The supervisors will delete any recordings that sound professionally made unless they know that the user has permission to upload the recording. Notwithstanding the above, the supervisors of the Zemirot Database disclaim any responsibility beyond that imposed by the laws of the United States to determine the copyright status of posted material. As explained in our DMCA Policy, as an internet service provider, the Zemirot Database benefits from the safe harbor provisions of the DMCA. If a user finds copyrighted content posted on the site without permission, he or she is requested to report the content using this form and the supervisors will attempt to determine the copyright status of the content and delete the content if, in their sole discretion, they determine it is necessary to do so. Copyright owners or their agents may submit a takedown notice pursuant to the Digital Millennium Copyright Act by following the procedures outlined in our DMCA Policy. Takedown notices may be submitted to our designated DMCA Agent, Mr. Philip Nicolosi, whose contact information is printed in the DMCA Policy. The DMCA Policy describes the information that must be included in takedown notices as well as the response of the Zemirot Database to takedown notices. Users must agree to the Terms of Use before creating an account, or, if no account is created, before uploading any material. The Terms of Use require users to certify that any content that they upload is in the public domain or that they are otherwise allowed to post the content on the Zemirot Database. The Zemirot Database is not a corporation or a business entity. It is a personal website run as a hobby by its supervisors, Mendy and Gabe. The supervisors are not paid and do not make any money from the Zemirot Database's operation. The website generates no revenue whatsoever, nor solicits donations. All expenses incurred by the website, such as web hosting, are paid by the supervisors. By agreeing to the Terms of Use, users license any content they upload (if it is not already in the public domain or freely licensed), permitting the Zemirot Database to display the work on the website, modify the work, erase the work, or sublicense the work to others. The Terms of Use also permit other users to modify or erase the version of the work displayed on the site. The users further certify that they have the ability to grant this license. The supervisors of the Zemirot Database hold a copyright over the content that the superivisors have created, including but not limited to the design, code, and instructions. Content that the users of the Zemirot Database have created and licensed to the Zemirot Database (such as user-created translations, transliterations, or recordings) may be distributed for non-commercial use to groups of fewer than 300 people, provided that the Zemirot Database is credited. When the creator of original content is identified on the "View Song" page on the Database (for example, a description under a recording indicating the creator of the recording), the creator should be credited as well as the Zemirot Database. Content may be distributed to larger audiences with permission from the Zemirot Database. Content that the users of the Zemirot Database have created and licensed to the Zemirot Database may not be reproduced for commercial use without permission from the Zemirot Database. Depending on the circumstances, the Zemirot Database may allow content created by anonymous or unidentified users to be reproduced or altered, provided that the Zemirot Database is credited. When the creator of original content is identified on the "View Song" page on the Database, the Zemirot Database may give permission for commercial users to reproduce or alter the content, but the creator should be credited as well as the Zemirot Database. Audio files from the Zemirot Database may not be embedded or hotlinked on other websites without permission. Content for which the Zemirot Database has negotiated or purchased a license should not be reproduced by users of the Zemirot Database. Please contact us for help locating the owner of the rights. Notwithstanding the above, users should make their own determination of the copyright status of works on the Zemirot Database before distributing works. Users are hereby advised that they should not redistribute or reprint any work on the Zemirot Database without making this determination. The Zemirot Database disclaims any responsibility from liability resulting from use of content on the Zemirot Database.
